He was examined on 13 August 1959 and 4 September 1959 and was found capable of work. There are detailed reports of the assessments as part of the Insurance Officer's submission. The claimant's grounds of appeal dated 18 August 1959 states 'Having had an accident in the colliery in June 1954 which resulted in 6 1/2 months in Pastures Hospital, I have now through this second accident to my leg, had a recurrence of my nervous trouble [...]' The claimant was found in favour of on 30 September 1959 and notes on the Tribunal report state 'Hit on leg by horse head (steel support in mine) about 3 cwt in weight [...]' and A difficult case, but the balance of probabilities lies in support of the claimant.' |
