Further information: In the Summary of facts on the Appeal referral, the claimant had an accident on 23 March 1951, when he 'struck his right elbow whilst shovelling dirt.' the loss of faculty was assessed initially at 20 per cent, and then 8 per cent for life. There were periods of time when special hardship allowance was disallowed, and although the claimant has a trial period in 1952, he has not returned to his original occupation. The last award of special hardship allowance ended on 26 August 1958. There is detailed information about his wages, and his grounds of appeal were that 'I would be earning £18 to £20 weekly in my pre-accident work.' In the Tribunal report, a letter dated 29 September 1958 states 'The work upon which he was engaged was of a special nature and higher than the general average.' The tribunal found in favour on 2 October 1958.
