Further information: There are two tribunal decisions - both deciding against the claimant. The most recent is dated 15 December 1958, and the previous one is dated 4 February 1958. There is a handwritten note on the 4 February decision 'also Med app Dec/57.' According to the Summary of facts on both the later and the earlier Appeal referral, the claimant injured his back and neck at Whitwell Colliery on 18 September 1956. He was assessed at varying degreesfrom November 1956 to 1957. After injury benefit was paid, up until 30 October 1956, the claimant returned to light work. Special Hardship ALlowance was paid from 31 October 1956 to 5 November 1957. On 16 October 1957 a Medical Board found the claimant fit for his usual occupation as a 'chargeman coal face getter'. His pay in this occupation was an average of £21 per week, and in his light work 'push-button job' he was receiving approximately £9 16s 0d gross. The Chairman's evidence on the Tribunal report states 'Only 47 years old, several years good service in him.'
