TitleLocal Appeal Tribunal case file for Eric Grainger, aged 51, Miner (packer) at Ripley
Date1958
DescriptionDate of birth:
Marital status: Married
Address: 89 Mill Lane, Codnor
Type of benefit claimed: Special Hardship Allowance
Type of injury: Injury - hand
Further information: Grainger's handwritten record of injuries started: '1923 Run over by Pony and Tubs at Ormond Lomane Colliery injuring my left leg and foot and body'. 5 further accidents listed. Accident under consideration in the Local Appeal occurred May 1955. Appeal Tribunal on 14 September 1955 was adjourned for medical evidence. Branch Secretary wrote to NUM after representing Grainger at this, saying 'Grainger has certainly got a very damaged right hand [...] it is impossible for him to either use a hammer or pick'. In a Postscript is added: 'Joe, I am on the phone now, and if it is useful to you, after working hours it is: Ilkeston 3864'. Doctor's letter states: I agree this man is at present unable to do his pre-accident work. The reason for this is that he has been for too long on too light a job [...] He should if possible be given work intermediate between his present job and his pre-accident work'. Local Appeal January 1956 awarded Special Hardship Allowance until April 1956, when Grainger was working still as a Conveyor and Transfer Point attendant.. A Local Appeal in May 1956 was adjourned to allow claimant and his representative to attend with medical evidence and the decision was then against Grainger in August 1956 (no fresh medical evidence seemed to have been gathered). After this the Compensation Agent in a letter stated: 'I am not at all surprised at the decision [...] I tried to put the case as best as I coud for him, but he kept butting in and mixing matters up'. Claimant then was working at Denby Hall colliery on light work. Another adjourned Local Appeal in June 1958 and another medical opinion was gained; this covered Grainger's previous leg injury in 1954 and stated that although Grainger believed that his leg problem was due to an accident this was refuted.
