Further information: According to the Summary of facts on the Appeal referral, the claimant had an accident on 30 July 1956 which resulted in a back injury. Special Hardship Allowance was awarded, but a renewal was disallowed from 27 August 1958 on the grounds that the claimant was not incapable of following his regular occupation. The Insurance Officer's submission states the Medical Board opinion that 'He says he does not want to go down the pit. He has not tried to go down the pit. The Board does not feel this is a genuine neurosis.' In the claimant's grounds for appeal statement dated 18 August 1958 he says 'the accident I received has badly frightened me, I also feel that my back won't stand up to the strain of my job as packer which means dragging about large lumps of rock under very cramped conditions, and I am afraid of getting another accident which might kill or cripple me for life.' The tribunal hearing disallowed the appeal on 11 September 1958. There is a handwritten note which includes the note 'neurosis condition.' In the Tribunal report, there is a statement by Mr Kitts recorded by the Chairman that says 'This case differs from RI. 85/52 in that there is a physical unfitness here.'
