Further information: According to the Summary of facts on the Appeal referral, the claimant had an accident on 14 May 1954 - he was buried by a fall of dirt and received multiple injuries. He was incapable of work until 28 June 1954. A Medical Board decided that he was fit to return to his pre-accident occupation on 1 July 1958 and Special Hardship Allowance was disallowed from 9 July 1958. The tribunal decision of 21 August 1958 was against the claimant and they accepted the Medical Board's report. It is noted in the evidence recorded by the Chairman 'Roof fall - multiple injuries whilst kneeling. Chest, neck and arm affected and stomach. Cannot bend or heavy lifting. Gummer - follow coal cutter. Goes under with shovel clears small coal out. Has to be agile for this job.'
