Further information: the claimant had an accident on 22 November 1953, injuring his arm, and a claim was settled on 22 May 1955. He was advised to make an application for a review under Section 40 of the National Insurance Industrial Injuries Act, which he did on 26 February 1957. There are handwritten notes from the claimant explaining why the accident was not reported at the time. There is some conflicting information in the paperwork, as the Summary of facts on the Appeal referral states the claimant had an accident on 22 December 1953 causing a pelvis injury. It also states the claimant's age as 49. Following the accident he worked as a conveyor attendant. There is a comprehensive specialist's report dated 24 October 1958 which states 'in December 1953 he slipped while carrying 6ft props and his back fell across a rail [...] In 1952 the patient had a fall of stone on the left elbow [...] This patient suffers from a generalised arthritis in the cervical, dorsal and lumbar regions of the spine [...] I understand he has been in the pit fifty years.' The tribunal hearing on 21 November 1958 found in favour and Special Hardship Allowance was payable from 1st October 1958 to 29 September 1959.
