Further information: According to the summary of facts in the Appeal referral, the claimant had an accident on 1 May 1958 when 'he fell backwards whilst lifting a derailed tub and injured his back.' He was examined on 14 August 1958 and the opinion of the medical officer was that he was fit to work in his usual occupation as draught door supervisor. The claim was for one day of injury benefit on 16 August 1958 when the Pit was closed. The tribunal disallowed the appeal on 23 September 1958 on the grounds that he 'fails to prove incapacity for work by reason of relevant injury on 16 August 1958.'
