Further information: Neale's application for continuing Sickness Benefit (he had received benefit between 30 November and 13 December 1955) was turned down by the Insurance Officer on 31 December 1955 on the grounds that Neale had failed to make a claim within the prescribed time, had not provided a medical certificate and was unable to prove there was good cause for the delay in making the claim. Neale, who had been in receipt of compensation under the Workmen's Compensation Act since 1942, told the Local Appeal Tribunal that had not been aware that his medical certificate had not been posted 'until the money did not arrive, then searching found it in a coat pocket I don't wear very often, it must have got mixed up with Xmas cards'. According to Joseph Kitts, the NUM Derbyshire Area's Compensation Agent, representing Neale at the tribunal, his explanation was genuine and that when the money failed to come through he had delivered the certificate by hand. The tribunal also considered the error to be a genuine one and allowed the appeal. |
