Further information: Mr Gay had an accident on 15 June 1951, aged 65, while working as a colliery road layer. Disablement benefit was awarded from 14 October 1951, with the latest assessment as 20 per cent for life from 14 March 1954. He was not entitled to special hardship allowance from 23 November 1955, and Mr Gay appealed against this decision on the grounds that he is unable to do work of equivalent standard. A tribunal hearing was adjourned on 20 December 1955 due to the question of overtime. There is a report dated 5 January 1956 providing details of overtime wages. The final decision by the tribunal on 19 January 1956 was in favour of Mr Gay.
