Title
Local Appeal Tribunal case file for Tich Henry Key Fretwell, aged 44, Underground at Markham No. 2
Date
1955
Description
Date of birth:
Marital status: Married
Address: 3 Houghton Crescent, Bolsover
Type of benefit claimed: Injury benefit
Type of injury: Injuries - knee and elbow
Further information: Injuries occurred when claimant had left work and travelled about half a mile on Markham Lane on foot, slipped on ice. Findings of Tribunal: 'Road belonged to NCB [...] Claimant had not left his sphere of employment'. Subsequently referred to the Commissioner by the Insurance Officer as the legal interpretation of whether claimant was 'disentangled [...] from work' was deemed unclear, or whether the accident did or 'did not arise out of and in the course of the claimant's employment'. The Commissioner upheld the Insurance Officer's appeal, stating 'It cannot truly be said of him [the claimant] that he was entitled to be at the scene of his accident by reason only of his employment'. Hand drawn map showing layout of route taken by claimant and marking the site of the accident included in file.
