Further information: Hicking's first claim for injury benefit was rejected by the Insurance Officer on 17 May 1950 on the grounds that Hicking's injury was not caused on or after the day of his accident; instead, it was suggested that Hicking's present incapacity was caused by the return of an old injury. When the case was brought before the Local Appeal Tribunal on 2 November 1950 Hicking's NUM representative tried to claim that Hicking had suffered a fresh accident and a new injury in the same place as the old one. This was rejected by the Tribunal on the grounds that there was no evidence of an industrial accident and that Hicking's incapacity resulted from his old injury.
There is a variety of correspondence relating to this case. It appears that Mr Hicking had an accident causing an injury to his left leg, which was reported on 5 August 1949 to the Ambulance Room at the Coppice No. 3 colliery. The decision by the Insurance Officer dated 17 May 1950 was that 'there was not an industrial accident on the grounds that the personal injury by accident was not caused on or after the appointed day.' The accident was deemed to have caused injury to an old wound from 20 years ago. The grounds for appeal were that Mr Hicking was paid 'National Health' at 26/- weekly, instead of injury benefit for a new accident. There is no paperwork to show the Tribunal decision, or if it even went to Tribunal.
