Description | Date of birth: 23/12/1911 Marital status: Married Address: 11 Snape Hill Crescent, Dronfield Type of benefit claimed: Injury benefit Type of injury: Injury - knee Further information: Initial claim for Injury benefit made on 23 November 1950 with diagnosis of cystic cartilage and Pearson reported that he had worked 25 years in the Waterloo No.1 pit and 'About 18 months ago May 1949, first felt pain in left knee. [...]I complained to deputy and fellow workmen from time to time.[…] Difficulty in straightening knee.[…] Operation is to be done as soon as possible'. Local Appeal at Chesterfield found in claimant's favour, but with a minority report from the Chairman: 'I agree condition of knee is due to claimants work [...] but I am unable to find any evidence of an accident at all'. A further period of incapacity to work was accorded Sickness Benefit. The case was referred to the Commissioner by the Insurance Agentas the medical evidence supported a degenerative process of the knee 'and would not arise from any particular incident'. The Commissioner's decision was that Pearson did not suffer personal injury by accident arising out of and in the course of his employment 'the incapacity in this case is not due to accident but to the process of the work'. |
