He received injury benefit and at the end of this period was awarded a disablement pension of 20 percent from 12 September 1950 to 11 January 1951. From September 1950 Booth began work as a haulage hand and was awarded a Special Hardship Allowance. He tried to renew this the following year but his claim was disallowed on the grounds that his overtime earnings had not been included in his pre-accident wages. The insurance Officer, in his submission to the tribunal, appears to have supported Booth's claim: 'As the actual difference between pre-accident and postaccident earnings is 1/11d it would appear that a wrong decision was given and an allowance on account of special hardship should have been made at the rate of 2/- per week [...] The Tribunal is therefore asked to revise the Insurance Officer's decision and to award a payment in addition to the disablement gratuity on account of special hardship'. There is no record of the tribunal's final decision. |
