Further information: Local Appeal Tribunal for Special Hardship Allowance was found favourable to claimant; this had been adjourned on 9 January 1951 for medical evidence. Previously to accident Baines had a small swelling in the groin but tripping made it worse causing an inguinal hernia. Within hours of the accident Baines was admitted to hospital with a perforated duodenal ulcer which was operated on. In August 1949 claimant had returned to his pre-accident employment. Hernia surgery in October 1950. Medical evidence considered the impact of both operations - stating that if the hernia had been the only disability Baines would have been able to reuturn to the coal face - but in view of abdominal wound from ulcer surgery the advice was 'to remain on light work'. Following this the Consultant in reply to Mr Kitts (NUM Compensation agent) stated: 'I have now had the opportunity of talking to one of my colleagues [...] [who] had a case of perforated duodenal ulcer where the question of injury arose [...] There is evidently quite a bit of literature about it and Court decisions have been given both for and against.' and 'If [...] you would wish me to go into this more fully, I will write to the Royal Society for Medicine and get all the literature bearing on the subject'. At hearing evidence included: 'In view of claimant's age, contends that he is unlikely to be able to return to coal face'.
