According to a summary of the case submitted to the Local Appeal Tribunal, the certified cause of Potter's incapacity, for the period 13 August 1949 to 25 February 1950, was 'Bronchitis and neoplasm lung'. Later, Potter was informed by his doctors, after a consultation with specialists, that he had pneumoconiosis. Potter's initia claim for disablement benefit was rejected by the Insurance Officer, however, on the grounds that he had not made the claim within the prescribed timescale and was not able to prove there was 'good cause for failure to make the claim'. The Tribunal found that there was good cause for delay and found in Potter's favour. The case was then referred to the Pneumoconiosis Medical Panel for assessment. |
