Description
Legal documents including plans from the Chapel-en-le-Frith District Surveyor's Office, briefs, counsel's advice and submissions to the Court of the Railway and Canal Commission in the matter of an application by T. Ryan Somerville & Co Ltd for the granting of rights to access both the railway and the public highway for the transportation of limestone. The case also involved the Chatsworth Estates Company, which disputed the highway status of the track in question. The judgment of Mr Justice Mackinnon, dated 21 Jan 1937, concludes that the Court had no jurisdiction to determine whether the track was part of the public highway. A letter from the Clerk of the Peace to the County Surveyor dated 30 Jun 1937 indicates that an agreement had been reached that the Chatsworth Estates Company should instead apply to Quarter Sessions for a diversion of the disputed road, bypassing the Hillhead Quarries company offices, while acknowledging that the highway in question is a public cart-road..
