Description
Reciting assignment of mortgage dated 3 May 1726 and agreement of same date (see D 779B/T 346-7) and witnessing that to secure payment of £240 and interest and for 5s. paid by 3. to 1., the premises in the mortgage are assigned for the remainder of the 500 year term to 3. discharged of the proviso for redemption, but provided that 1. carries out terms of agreement dated 3 May 1726, paying £12 annually to Robert Lown for life and, after his death £6 annually to Mary Lown in lieu of dower, and £240 to Diana Lown on Robert's death if his wife is dead, then the trustees are to hold the premises to 1.'s use to attend the inheritance.
D779/T/3/3/22 is endorsed with 1) agreement that Robert Lown shall have £40 now and still have £12 annually, interest on the £40 to be deducted from Diana Lown's money, if Robert Lown lives for 5 years, thereafter it will be borne by Robert Holden of Foremark 2) receipt of £40 paid to Robert Lown by Holden of Foremark, being part of the £240, the payment agreed to by Diana Lown, 20 Jan. 1726/7 3) receipt for £40, part of the money mentioned in the deed, by Robert Storer of Long Eaton yeoman and wife Diana, formerly Lown, from Holden of Foremark, for which they will pay interest to Holden until the time her money becomes due to Diana Storer, 6 May 1730 4) receipt by Robert Storer from Holden of Foremark for further £20 and promise to pay interest, 22 March 1730/1 5) receipt for £126 7s 6d, the remainder o the £240 due to Diana Storer, Robert and Mary Lown having both died last October, 6 November 1731.
D779/T/3/3/23 is endorsed with 1) and 2) as above and with receipt for £4 19s, which with £1 1s received before, is annuity for half a year due last Michaelmas to Robert Lown deceased, paid to Phoebe Lane executrix of Robert Lown. Signed also by James Lane her husband, 23 November 1731.
