Further information: According to the Summary of facts in the Appeal Referral, the claimant 'was walking along the pit lane on 13.8.59 a few minutes after 3.p.m. when he slipped on the uneven surface of the road and injured his ribs.' There is paperwork relating to where the accident happened, including a plan of the colliery and the road drawn up by the Insurance Officer. The road was on NCB property but the public have right of way. It is noted that 'incidentally the road is being repaired at the moment.' The claim was disallowed and the claimant appealed against the decision and argued that it happened at his place of work. It is noted in the Report of Proceedings that 'The Pit lane also leads to Mapperley Village.' The appeal was disallowed on 16 October 1959 and in the Findings note that 'The facts of this case fall squarely within Commissioner's decision C.I. 39/50.'
