Further information: According to the Summary of facts on the Appeal referral, the claimant injured his leg in an accident on 28 March 1957 and was incapable of work for 2 months. He was given a final life assessment at 2 per cent. After the accident he worked as a Back Ripper and claimed special hardship allowance due to the difference in wages. It was paid until September 1959 when he was declared fit for his regular occupation by a Medical Board. The claimant's grounds of appeal dated 15 September 1959 states 'At times the knee gives way and I must clutch something for support, this has occurred several times before witnesses and besides being embarrassing is dangerous in the pit or street.' The Local Appeal Tribunal found against the claimant on 1 October 1959. In the Note of evidence recorded it states 'Not back ripping. It is back dinting. Can only kneel for about quarter of an hour. Must be agile for coal face work. 2 miles walk each way to coal face.' There is a Doctor's report dated 31 October 1959 which states 'In March 1957 right leg was pinned by a piece of stone against a steel cable [...] although understandably this man has some pain on prolonged kneeling he should be able to perform his oold work.' Following this the Compensation Agent wrote to the claimant on 3 November 1959 stating it would be difficult 'in sustaining a claim with the Ministry.' In the claimant's reply dated 20 November 1959 he states 'Since reading the report I have determinedly knelt for as long as possible at my work [...] the upper leg in the meantime becoming more painful and losing flexibility [...] P.S. Personal remarks - I have reason to believe that Dr Strabinski is one of the 'Examiners' who previously gave the verdict aganist me and now feels he must justify himself by repeating that verdict.' A reply from the Compensation Agent dated 23 November 1959 states 'I would however point out that Dr Skibinski has no connection at all with the Ministry of National Insurance examinations. He is the medical practitioner whom the Union have used on many occasions for medical examination of our members.'
