The claimant returened to his pre-accident work as a coal cutterman on 21 September 1959 and reported it on 28 September 1959. Special Hardship Allowance was then disallowed and an overpayment of 34/- arose. There is a transcript of correspondence included in the Appeal referral, and an extract states 'I really thought I acted in quite good faith when the Allowance was drawn [...]' There is also a note attached from the Insurance Officer's submission regarding the question of wages and payment in arrears. On 18 November 1959 the tribunal allowed the appeal. |
