Further information: Appeal for Special Hardship Allowance was against the claimant because the Medical Board attributed Johnson's knee pain and inability to kneel as due to Paget's disease. The GP supplied a letter to say that prior to Johnson's accident he had made no complaints about his knee and that a patient may have Paget's disease for years and not consult a doctor. The appeal was adjourned and Mr Kitts for the NUM asked for an appeal to the Commissioner, stating: 'whether Mr Johnson had Paget's disease or not [...] he was able to do his job as a packer'. The Insurance Agent submitted the appeal stating he was unable to support it. The Commissioner ruled against Johnson, concluding that 'the incapacity due to the accident does not in itself render the claimant incapable of following his regular occupation'.
