DescriptionConcerning land and property purchased in the names of John Burton, mercer, Richard Wilkinson and John Wilkinson, grocers and Henry Smith, woolcomber, all of Chesterfield, from Stephen Egginton of the town of Nottingham, gent and Judith his wife in consideration of £2,100, namely, a close or parcel of land called Dick Eye lying in Matlock near the River Darwent containing 2½ a and being of the nature of freehold, and also another close or parcel of land called Joan Eye lying in Matlock near the River Darwent containing about half an acre, adjoining and laid open to the said Dick-Eye at the south end and being sometimes considered a freehold and sometimes a copyhold tenure within the manor of Matlock, and all that close lying in Matlock and Bonsall, heretofore called the Finneys but now called the Shoulder of Mutton, containing about 4a, an also 1a of inclosed land lying in Matlock at the upper end of two acres formerly purchased by Thomas Godbehere, deceased from Thomas Bowne and others all of which premises were late in the possession of Philip Hutchinson, and all that copyhold messuage, dwelling house or tenement and three gardens thereto adjoining, lying in the manor of Matlock, formerly in the possession of Widow Radford, with all appurtenances, and also such a part, share or proportion of the royalty or manor of Matlock as the sum of ten pence bears in proportion to the sum of £14 13s 5d., and also all that spring of water called Warmwalls Spring situated within the said manor and parish of Matlock with the two buildings erected upon the same called the Old Bath house and the New Bath house with the dressing rooms adjoining each of them and the several chambers, rooms or apartments over the said New Bath house and dressing rooms, and also that ancient house or building standing near to and at the south end of the said Bath Houses, and also all that dwelling house called the Upper House at some little distance northwards from the said Bath houses with the buildings adjoining thereto called the Myners Room and the Cock Pitt, and also all that other dwelling house called the Neather House at some little distance southwards or south eastwards from the said Bath houses, and also all that building called the Slaughter house standing at a little distance northwards from the said Upper House and the several barns, stable’s corn chambers, hay chambers and hovels standing near, and also one half acre of the common or waste called Matlock Wood, lying near and adjoining the said Bath houses, and whereon the said Bath houses and other buildings now stand, and all other buildings and appurtenances of the said premises, which said last mentioned premises are of a leasehold tenure for the remainder of a term of 900 years. The trust of all the aforesaid purchased estates has by an indenture of equal date with these presents made between John Burton, Richard Wilkinson, John Wilkinson, and Henry Smith, of the one part, and the said Samuel Clark, Richard Milnes, Adam Slater, Richard Slater, Godfrey Heathcote, Joshua Jebb and Samuel Jebb, been declared in the following manner namely, one further part each for the said Samuel Clark and Richard Milnes, one eighth part each for the said Adam Slater, Richard Slater and Godfrey Heathcote and one sixteenth part each for the said Joshua Jebb and Samuel Jebb. The said five men stand possessed of large quantities of household goods and furniture, plate, linen, china, glass and earthenware, brewing vessels, wine, ale and other liquors within the aforesaid dwelling houses, and of considerable quantities of hay and corn within the outhouses belonging to the said dwelling houses and, being so possessed now in partnership, carry on the business of a vintner and victualler at the aforesaid dwelling houses for the convenience of persons frequenting the said baths
