<dc:title>Local Appeal Tribunal case file for Albert Edward Plews Moorley, aged 58, [job not stated] at Shirebrook</dc:title>
  <dc:description>Date of birth:
Marital status: Single
Address: Not given, Not given
Type of benefit claimed: Injury benefit
Type of injury: Injury - neck
Further information: Accident certified as 'neck strain' had occurred when Moorley slipped whilst carrying a bag of cement. Subsequent medical certificates gave cervical arthritis and an X-ray showed 'gross hypertrophic arthritic changes of the cervical spine'. Debate about whether incapacity to work was as a result of the injury or the underlying condition occurred and Tribunal findings gave: 'On the balance of probabilities and in view of the fact that the neck trouble was not apparent before and became apparent immediately after the accident [...] the arthritic condition was aggravated by the neck injury'.</dc:description>
