DescriptionWilliam Heyward of Birchelles (co. Derby), husbandman, and Raufe Heyward, son of John Heyward, deceased, agree, touching one messuage and certain lands in Tunstead in the occupation of Emott Bennett, widow (concerning which strife has arisen and an award been made by Raufe Higeden, parson of Langeley and Roger Smith of Bakewell), to do and suffer such legal actions as will assure to each other a moiety of the messuage. The strife had arisen from the fact that Henry Heyward was seized in fee of the premises and had issue two sons, John Heyward, priest, and the said John Heyward, father to Raufe, both born at a birth, and it was doubted which was the elder brother and heir to Henry. John Heyward, priest entered into possession and sold the premises to William, brother to the two Johns. The terms of the award are given.
